虽然国家已经陆续颁布了《劳动合同法》与《劳动争议调解仲裁法》，但是
社会及民众对高效的劳动争议调解机制的需求日渐增多，劳动争议调解能力
在一定程度上严重的影响到了鄂尔多斯市的社会和谐。

基于此，本文首先分析了劳动争议调解的内涵及其特征等相关理论知
识；其次，对劳动争议多元调解机制的内涵、思路、原则、理念及一般模式
进行深入的分析；再次，本文通过问卷调查的形式，从调解组织中日常参与
调解工作的人员比例、一般劳动争议案件调解周期、劳动争议主体及其对一
般性劳动争议的态度、调解困境、与其他单位合作调解的频率，以及鄂尔多
斯市企业近三年来劳动争议案件数量及类型等七个方面，分析了鄂尔多斯市
现行的劳动争议调解机制存在的问题及原因；接着，本文首先采用 SWOT
分析法对鄂尔多斯市构建劳动争议多元调解机制的环境进行分析，确定该机
制构建的目标，进而针对鄂尔多斯市的具体情况，以及多元调解机制的思想，
从建立以企业内部调解委员会为中心、横向及纵向调解体系、调解网络关系
的形成及制度建设、人才培养及激励制度、前期及后期控制和反馈机制的构
建等多角度，提出劳动争议多元调解机制的构想；最后，本文就所提出的劳
动争议多元调解机制影响因素进行分析与排序，确定最关键、最重要及一般
的影响因素。

The Research about Building the Ordos City
Enterprise Labor Dispute Diverse Mediation
Mechanism
Abstract
With the rapid economic and social development in Ordos City, the
structure of the labor market has undergone a lot of changes and labor relations
are becoming increasingly complex, labor dispute cases also showed a sharp
upward trend. Although the country has successively promulgated the Labor
Contract Law and Labor Dispute Mediation and Arbitration Law, but the
demand of society and the public for efficient labor dispute mediation
mechanisms is growing increasing, labor dispute mediation capacity, to some
extent, impacts to the Ordos City’s social harmony seriously.
This paper first analyzes the connotation and characteristics of the labor
dispute mediation and other related theoretical knowledge; then we in-depth
analysis of the connotation, ideas, principles, philosophy , and the general
pattern in the diverse mediation mechanisms of labor dispute; after this, through
the form of questionnaires, from the proportion of the staff who participate the
mediation work in mediation organization, the mediation cycle of general labor
disputes, labor dispute body and it’s attitude of the general labor dispute,
mediation plight, the frequency of cooperation mediation with other units, and
the number and type of Ordos City labor dispute cases in the past three years, we
analyzed the problems and the causes about the current labor dispute mediation
mechanisms of Ordos City; Finally, against the specific circumstances of the
Ordos City, as well as the idea of diverse mediation mechanism, we proposed
the ideas about diverse mediation mechanism of labor dispute from the building
the city administrative mediation center, transverse and longitudinal mediation
system, the formation and institution building of mediation network relationship,
personnel training and incentive institution, the structure of pre-control and
